The immigration petition has to be filed by a specific employer and can be done through Form I-140, Immigrant Petition for Alien Worker. The immigration petition must be approved before the immigrant starts work. Once the immigration petition is approved, he or she will receive a notice from USCIS (U.S. Citizenship and Immigration Services) approving his or her immigration petition and order for a visa number. This only means that if a visa number becomes available, the person will be eligible to apply for immigration to the United States. It does not mean he or she has been granted immigration status yet.

Immigration to the USA – for Work purposes

Every year, thousands of individuals immigrate to the United States for work-related purposes. According to data from the U.S. Department of State and USCIS, in recent years it has become more and more difficult for employment-based applicants to receive visas due to an increased number of immigrants applying each year.

In 2016, it is estimated that there were 1.4 million applicants for employment with Green Cards.  In 2017, it is estimated that around 70% of applicants were approved for visas. In 2018, it was found that there was a backlog of over 370,000 applications that had been waiting for Green Cards to become available.
